Section 12
Amendment to Notice

(1) The preliminary notice may be amended by one or more amendments. The notice of amendment of the initial notice should contain the following:- (a) The initial notice should be identified by the registration number, (b) The mortgagee mentioned in the notice authorizing the amendment should be identified, (c) The fact that the notice is sought to be amended should be clearly disclosed. , (d) To show that the notice has been amended, the notice should be completely rewritten and all the information that should be disclosed in the initial notice should be provided. If a mortgagee is included in the notice, the amendment will be valid. Regardless of what is clearly mentioned in the contract regarding the benefit of the mortgage or not, after such agreement is made, the mortgagor shall be deemed to be authorized to register the amendment to include the mortgaged property and the benefit received from the said agreement. (3) Name of more than one person as mortgagee in the notice. If so, each such person may authorize someone to register the amendment. (4) If the name of more than one mortgagee is mentioned in the notice, the amendment shall be valid if one of the mortgagee authorizes the registration through a signed record. (5) One mortgagee mentioned in the notice shall authorize The given amendment will not affect the right of another person to take the mortgage mentioned in the notice. (6) The amendment to add the mortgage property will be valid only from the date of registration of the amendment in the case of the added mortgage property. (7) If the amendment is registered to add the mortgagee, then The amendment shall be valid only from the date of registration of the amendment in the case of the mortgagee added.The amendment will be valid only if the authority to register the amendment is given. An amendment that does not mention the name of a new mortgagee in place of the removed or thus removed mortgagee shall be invalid. (10) The registration of the amendment shall not extend the validity period of any notice.
